On September 6, 2024, Governor Maura Healy signed into law H5033 (An Act to Improve Quality and Oversight of Long-Term Care) known as the Long Term Care bill. The legislation related to the bill has been long advocated by numerous groups, including the Massachusetts Chapter of the National Academy of Elder Law Attorneys (MassNAELA). Some highlights from the bill include:
- Funding of pooled trusts for individuals age 65 and over are considered a transaction for fair market value and can be utilized again as a MassHealth planning option. This will allow individuals who need nursing home level of care to set aside funds for expenses not covered by MassHealth.
- Estate recovery will be limited to federally mandated recovery, and CommonHealth will be excluded from recovery.
- MassNAELA will have representatives on multiple state commissions which will allow this experienced group of elder law professionals to have direct input on the future of care in Massachusetts (Assisted Living Residences, CCRC’s, etc.).
